An Auckland landlord has been ordered by a court to pay over $30,000 to a tenant family who endured extreme living conditions in an illegal rental property. The family suffered from issues such as carpets soaked with sewage and ongoing water supply problems.
According to a recent ruling from the Tenancy Tribunal, the tenant family, consisting of two adults and two children, endured severe hardships in their rental property located in Albany Heights. The family moved into the unit at 310 Dairy Flat Highway in December 2023, but the unit, owned by landlords Lingzhi Yuan and Lei Yang Shen, had been converted from an old farmhouse into two separate units, forcing tenants into unreasonable living conditions. The property was managed by Ashton NZ Property Ltd.
‘Ongoing Inconvenience Due to Sewage Issues’
The most significant issue was the sewage problem. On April 14, 2024, a clogged toilet caused sewage to flood the bathroom, soaking the carpets in the area. The family immediately contacted the property manager but received no response. The family attempted to resolve the issue by hiring a plumber, but the problem kept recurring, leaving them in discomfort.
A month later, on May 4, the property manager finally reached out, instructing the tenants to remove the carpet soaked with sewage and clean the floor. However, the tenants refused to remove the carpet, as it had been soaked with raw sewage. Multiple visits from plumbers failed to fix the issue. Ultimately, the tenants were forced to rent a portable toilet, and the landlord covered the associated costs for its use from May 6 to July 10.
‘Severe Water Supply Problems in the Illegal Housing’
In addition to sewage issues, the tenants also faced significant water supply problems. The three units shared an 11,000-liter water tank, which frequently broke down, causing water outages lasting 24 to 48 hours. The tenants reported continuous water shortages and claimed that the poor water quality, which was both cloudy and unpleasant in taste, caused them to suffer from stomach issues. Despite the tenants’ complaints, the landlord refused to replace the tank due to cost concerns, leaving the tenants with no choice but to buy bottled water.
Court-submitted photos revealed thick, black sediment about 10 cm deep on the bottom of the water tank, further worsening the water quality.
‘Court Orders Compensation for Tenant Family’
The tenants, faced with these appalling living conditions, filed a lawsuit in court. Ultimately, Judge Michelle Pollack ruled that the landlord must pay over $30,000 in compensation. Judge Pollack pointed out that the landlord failed to take appropriate action to address the issues and neglected the risks posed to the tenants’ health by the sewage-soaked carpet.
This case highlights the ongoing problem of illegal housing in Auckland and underscores the poor management of rental properties, shedding light on the suffering of tenants living in substandard conditions.

‘하수 문제로 끊이지 않는 불편’
가장 큰 문제는 하수 문제였다. 2024년 4월 14일, 변기가 막히고 오수가 유입되면서 욕실 주변의 카펫이 젖어버렸다. 세입자 가족은 즉시 부동산 관리인에게 연락했으나, 응답을 받지 못했다. 결국, 가족은 배관공을 불러 직접 문제를 해결하려 했지만, 문제가 반복적으로 발생해 불편을 겪어야 했다.
한 달 후인 5월 4일, 부동산 관리인은 뒤늦게 연락을 취해 하수에 젖은 카펫을 뜯어내고 바닥을 청소하라고 요구했으나, 세입자들은 원시 하수에 젖은 카펫을 직접 뜯는 것을 거부했다. 이후 여러 차례 배관공들이 방문했지만, 문제는 해결되지 않았다. 결국, 세입자들은 이동식 화장실을 대여해 사용할 수밖에 없었으며, 이 기간 동안 발생한 비용은 집주인이 부담했다.
‘불법 주택에서의 물 문제도 심각’
하수 문제 외에도 세입자들은 물 공급에 대해서도 큰 불편을 겪었다. 세 유닛이 공동으로 사용하는 11,000리터 규모의 물탱크는 자주 고장이 나며, 물이 24~48시간씩 끊어지기도 했다. 세입자들은 이로 인해 계속해서 물 부족 문제에 시달리며, 불쾌한 물맛과 탁한 물로 인해 배탈까지 발생했다고 주장했다. 이 문제에 대해 집주인은 비용 문제로 탱크를 교체하지 않았으며, 결국 세입자들은 생수를 구입해 사용하는 상황에 놓였다.
법원에 제출된 사진에 따르면, 물탱크 바닥에 두께가 약 10cm에 달하는 두꺼운 검은 침전물이 쌓여 있었고, 이는 물의 품질을 더욱 악화시켰다.
‘법원, 세입자 가족에 대한 배상 명령’
세입자들은 이러한 열악한 주거 환경으로 인해 법원에 소송을 제기했고, 결국 재판관 미셸 폴락은 집주인에게 3만 달러 이상의 배상금을 지급하라는 결정을 내렸다. 폴락 재판관은 집주인이 문제를 해결하기 위한 적절한 조치를 취하지 않았으며, 하수에 젖은 카펫이 세입자들의 건강에 미친 위험을 간과한 점을 지적했다.
이 사건은 오클랜드의 불법 주택 문제와 주택 관리의 부실함을 다시 한번 부각시키며, 불법 주거 환경에서 생활하는 세입자들의 고통을 여실히 보여준다.
